A panel of the United States Court of Appeals for the Ninth Circuit has held that Hawaii's ban on butterfly knives violates the Second Amendment. In its decision, the Court reversed the district court's judgment in favor of Hawaii and remanded the case back to the district court “for further proceedings consistent with this opinion.”

“...President Biden continued his siege on the Second Amendment by announcing gun-control regulations targeting self-manufactured arms and confirming his intention to nominate Steven Dettelbach, an Everytown for Gun Safety-endorsed, anti-Second Amendment zealot to lead the ATF. Biden’s proposed rule to eliminate so-called “ghost guns” would create an entirely new class of highly regulated items by redefining the term “firearm” to include a host of parts, and collections of parts ATF now considers “readily” convertible into functional firearms. This move calls into question the legality of an unknowable number of parts and kits purchased by peaceable people for decades.
"NSSF listened with keen interest to President Joe Biden’s nomination of Steve Dettelbach for Director of the ATF. NSSF has long-advocated that the ATF needs a U.S. Senate-confirmed director, and that person must be an individual who will faithfully execute the duties of regulating the firearm industry in accordance with established laws and regulations….NSSF is also closely monitoring the submission of the Final Rule by the Department of Justice (DOJ) to redefine frames and receivers, which would significantly alter the sale and possession of not only personally-made firearms (PFMs) but numerous other types and models as well. NSSF will review the Final Rule carefully to see if DOJ listened and took into consideration the industry’s comments that were submitted.
In a White House Rose Garden ceremony yesterday, President Biden announced his nomination of former US Attorney and failed Ohio Attorney General candidate Steve Dettelbach to head the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). He also used the occasion to announce his latest firearms regulation designed to place regulations on 80% firearms kits the administration has continued to brand “ghost guns.”

“It is deeply troubling to see President Biden once again nominate someone with an anti-gun record to serve as the new ATF Director. This, along with the Administration’s proposals with respect to so-called ‘ghost guns’ are just the latest evidence that the Biden Administration is more focused on restricting Americans’ God-given right to self-protection than targeting criminals and reducing violent crime. Nothing that the President is proposing today will make Americans safer in the face of skyrocketing crime because criminals by definition do not abide by the law."
Earlier this week, we told you that SHOT Show 2022 was a definite “go” -and broke the news that SIG Sauer had notified the National Shooting Sports Foundation that ongoing Covid-19 concerns would prevent their participation. Late last night, we learned that the glaring space formerly occupied by SIG (SHOT’s largest footprint at 70x200) would not be empty. Under the SHOT Show/NSSF point allocation system, the option for that now-available space would fall to the highest priority point holder. The space was offered, and the offer was accepted. When SHOT 2022 opens its doors, the new tenant of that very-significant space will be Vista Outdoor. The realignment of space due to the SIG Sauer decision may impact other exhibitors as well. Or, we’re told, the NSSF may “repurpose” the space. It’s a developing story, and as always, we’ll keep you posted.
The Second Amendment Foundation is applauding the Ninth U.S. District Court of Appeals decision to vacate an injunction obtained earlier in a lawsuit filed by 22 state attorneys general and the Attorney General for the District of Columbia, against an agreement between the State and Commerce departments and SAF and Defense Distributed allowing them to post data relating to 3-D printing of firearms on the Internet.
A new survey by McLaughlin & Associates, a nationally-recognized polling firm based in Blauvelt, New York, shows overwhelming public support for the Second Amendment right to keep and bear arms, and a clear majority belief that more gun control laws would not have prevented recent mass shootings in Georgia and Colorado. According to the survey results, 52.2 percent of the public thinks better enforcement of existing gun laws is the right approach to reducing violent crime, and 55.5 percent want politicians to focus on current laws rather than enact more laws (36.1%). Importantly, 58.1 percent of Americans believe any proposed firearm policies should be debated and enacted through a democratic process, while only 31 percent think the president should enact policy by executive order.

On Friday, a three-judge panel in the Ninth Circuit Court upheld a lower court ruling that found the California state ban on standard capacity magazines violates the Second Amendment and is unconstitutional. The ruling by U.S. District Court Judge Roger T. Benitez in Duncan v Becerra that California’s ban on possessing firearm magazines capable holding more than 10 rounds violates the Second Amendment, the panel effectively affirmed that laws seeking to curtail firearms owners’ rights should be viewed under strict scrutiny, rather than the lesser standards used by California when it enacted the ban.

By an overwhelming vote of 310-107 the U.S. House of Representatives has approved the Great American Outdoors Act, allocating funding for the much-needed repairs of infrastructure on public lands. The final step for the GAOA is the signature of President Trump. He has indicated his willingness to sign the measure, allocating funding for “our BEAUTIFUL public. lands.”
